The Addressing corporate misuse of the Fair Entitlements Guarantee discussion paper is now available and stakeholders are invited to make submissions.

The Department of Employment and Workplace Relations (DEWR) invites interested stakeholders to respond to questions about potential reforms raised in the paper directed at addressing corporate misuse of the Fair Entitlements Guarantee (FEG).

FEG is a legislative safety net scheme of last resort through which the Australian Government advances certain unpaid employee entitlements to eligible employees who have lost their jobs due to the insolvency of their employer and entitlements cannot be paid from another source.

Inviting submissions

DEWR invites interested stakeholders to respond to questions about potential reforms to address the deliberate structuring of corporate groups to avoid paying employee entitlements. In addition, the department also invites interested stakeholders to consider other potential measures to better protect employee entitlements from sharp practices and to reduce the impost on taxpayers.

This includes:

  • better protecting employees’ entitlements in insolvency
  • improving access to information held by controllers
  • increasing director accountability for unpaid employee entitlements in insolvency.
