Statutory Review of the Operation of the Fair Work (Registered Organisations) Amendment (Withdrawal from Amalgamations) Act 2020

The Fair Work (Registered Organisations) Amendment (Withdrawal from Amalgamations) Act 2020 (Cth) made amendments to Part 3 of Chapter 3 of the Fair Work (Registered Organisations) Act 2009 (Cth) (the RO Act) which deals with withdrawal from amalgamations. It included an amendment that a review of the operation of these amendments must be completed, and a written report given to the Minister, no later than the second anniversary of the day the amendments occurred (s 92A). That is, 16 December 2022.

In line with these requirements, the Department of Employment and Workplace Relations (the Department) conducted the review. Noting the limited data and evidence about the use and impact of these provisions, the Department made no recommendations.
