Maximum Time Transfers Guideline

Maximum Time Transfers ensure job seekers who have been with the same provider for an extended period without achieving an Employment Outcome or an HTS jobactive Outcome are transferred to a new provider. This will give job seekers different servicing which may improve their prospects of getting a job. 
Job seekers who remain unemployed for 2 years in Stream A or 3 years for Streams B and C with the one provider will usually be transferred, along with the equivalent Business Share, to another provider in the same Employment Region. Providers’ Business Shares will be adjusted at quarterly intervals for the job seekers transferred.

Notice regarding Maximum Time Transfers (MTT) Pause
On 7 April 2020, the Department advised that the MTT process had been paused as part of the COVID-19 contingency arrangements. The pause of the MTT process has now been extended until the end of the jobactive Deed 2015-2022 (the Deed) on 30 June 2022, effectively ending MTT in jobactive. 
Participants who would otherwise be transferred under the MTT process will remain able to change providers under normal jobactive transfer arrangements should they wish.

Privacy Guideline

This Guideline assists Providers who deliver services under any deed that the Department of Education, Skills and Employment (the Department) administers that may refer to this guideline  to comply with the Privacy Act 1988 (Privacy Act), including the Australian Privacy Principles (APPs). 

The Privacy Act regulates the handling of personal information and sets out principles for the management, collection, use and disclosure of personal information. All APP entities, including the Department, Providers and Host Organisations must comply with the Privacy Act.
This Guideline is not a stand-alone document and does not contain all of Providers’ obligations contained in the respective Deed(s). Providers must ensure they comply with: 

the Privacy Act; 

the social security law; and 

other legislation or laws relevant to the respective jurisdictions in which they operate, including privacy, work health and safety or anti-discrimination obligations that apply under State or Territory law.

This Guideline is not legal advice and the Commonwealth accepts no liability for any action purportedly taken in reliance upon it. This Guideline does not reduce the obligation of Providers to comply with their relevant legal obligations and, to the extent this Guideline is inconsistent with obligations under the Privacy Act, social security law or any other legislation or laws relevant to the respective jurisdictions in which Providers operate, the Privacy Act, the social security law and the other legislation or laws, respectively, will prevail. 

This Guideline must be read in conjunction with the respective Deeds and any relevant Guidelines or reference material issued by the Department under, or in connection with, the respective Deed. 

Work for the Dole Guideline

Work for the Dole is designed to help Participants gain the skills, experience and confidence needed to move from welfare to work as soon as possible. It provides a valuable opportunity for Participants to demonstrate their capabilities and positive work behaviours which will stand them in good stead with potential employers while at the same time making a positive contribution to the local community.

Job seekers generally have Mutual Obligation Requirements, such as looking for work and participating in Activities that will improve their employment prospects. These include the requirement for job seekers to participate in Work for the Dole or other approved Activities in order to meet their Six Month Activity Requirement (SMAR) and Annual Activity Requirements (AARs).

Work health and safety is a fundamental requirement of the Work for the Dole Program. Participants must be safe at all times when participating in Work for the Dole Activities. Work health and safety needs to be assessed at the outset when contemplating whether an Activity is suitable for Work for the Dole. Where work health and safety concerns are identified that cannot be removed or adequately controlled, the Activity must not proceed as a Work for the Dole Activity.

This Guideline outlines the requirements for jobactive providers (Providers) when setting up and managing Work for the Dole Activities. It includes specific requirements for ensuring that there is a safe system of work in place at all times during the conduct of a Work for the Dole Activity.

Transfers Guideline

Participants may transfer between Providers for a range of reasons. Transfers can be automatic or involve a manual process, and can be initiated by the Participant or a Provider.

Participants can also transfer into and out of New Employment Service Trial (NEST) regions under arrangements set out under the Transfers (NEST) Guideline. 

Transfer arrangements support continuity of servicing when Participants change location, and support Participant choice of Provider.
